The Museusdienst Berlin of Kulturprojekte Berlin GmbH organises events (guided tours, workshops, etc.) in cultural institutions and in public spaces. The respective institution or organiser is responsible for the content and scope of the exhibitions. These GTC apply to all events and other services (so-called offers) of the Museumsdienst of Kulturprojekte Berlin GmbH. The house rules of the exhibition building/museum apply in each case.
2.1. A booking enquiry is made via the online form on the website www.museumsdienst.berlin. After sending the enquiry, you will receive an e-mail confirmation of your enquiry. Individuals and groups can also make bookings for Museumsdienst programmes by e-mail or telephone in individual cases. The respective booking e-mail addresses or booking telephone numbers can be found on the Museumsdienst website.
2.2. The pre-booking deadlines for the respective offers apply, as stated on the Museumsdienst website.
2.3. In the case of events for school classes, children and young people, the age restrictions must be observed. In the case of school classes or a visit as part of an educational event, the school/educational institution is the contractual partner of the Museum Service; this also applies to bookings/booking enquiries from travel companies.
3.1. When booking individual registrations and group registrations via the designated booking system (booking registration) on the Museumsdienst website, a binding offer for the selected event is submitted by clicking on the ‘Book now’ field. After confirming the booking email, customers will receive a booking voucher by email. Upon receipt of the booking voucher, the contract is deemed to have been concluded exclusively between the customer and Kulturprojekte. The booking enquiry via the booking form on the website or via telephone or email is also considered a binding offer. The offer is accepted by means of a written or electronic booking or order confirmation. No guarantee is given for the accuracy of the data provided by customers via the booking form or by telephone. It is assumed that the customer has read and accepted these GTC in full before making a booking via the website, by telephone, post or email. If customers do not receive a booking or order confirmation within 3 working days, there may be a technical error. Customers are required to inform the Museumsdienst of this.
3.2. In the case of programmes with a minimum number of participants, the booking confirmation (acceptance of the offer) is subject to the condition precedent that the minimum number of participants is reached by the registration deadline. If the minimum number of participants is not reached, the registered participants will be informed of the cancellation of the event. Amounts already paid will be refunded.
3.2. In the case of programmes whose number of participants is limited in accordance with the offer description, bookings will be considered in the order in which they are received, regardless of the booking method. If a booking cannot be honoured, the customer will be informed immediately. A booking confirmation will then not be issued.
4.1. In the case of group offers with an all-inclusive price, the customer is obliged to pay the fee in full even if the number of participants and thus the size of the group is reduced on site.
4.2. There is no entitlement to a reduction in the fee if Museumsdienst offers are postponed by up to 30 minutes.
4.3. All prices are final prices. In accordance with § 4 No. 20 a UStG, no sales tax is charged.
4.4. Invoices are sent at the customer's risk to the e-mail address or postal address provided by the customer.
There is no right of cancellation for consumers in accordance with § 312g para. 2 sentence 1 no. 9 BGB.
5.1. for contracts for the provision of services in connection with leisure activities or bookings of events, if the contract provides for a specific date or period for the provision of services. For all other contracts (except for the purchase of admission tickets) with consumers, the statutory right of cancellation applies, which can be exercised informally until the end of the cancellation period at the Museumsdienst: museumsdienst@kulturprojekte.berlin with the subject ‘Cancellation’.
6.1. Customers can cancel or rebook their participation in the booked offer in writing (e.g. e-mail, letter) up to seven working days or the cancellation period stated on the booking voucher before the event date free of charge. In the event of cancellation by telephone, the customer must then cancel in writing. In the event of cancellation, the time of receipt by the Museumsdienst shall be decisive. The customer must provide proof of this. Only working days (weekends and public holidays are excluded) apply when calculating the deadline.
6.2. No fee will be charged for booked events that are cancelled within the cancellation period. For cancellations that are cancelled outside the cancellation period, the agreed fee is due in accordance with § 615 BGB. This applies accordingly in the event of a no-show at the start of the offer or if the participants are more than 30 minutes late.
6.3. If an offer is free of charge or subsidised, the costs incurred in the event of cancellation outside the specified period or in the event of no-show will be charged in full in accordance with the duration of the offer.
The customer is entitled to the execution of the offer up to a maximum of 30 minutes after the start of the offer for the remaining time of the duration from the start of the event stated on the booking voucher.
The Museumsdienst is entitled to cancel offers at any time for good cause, e.g. force majeure, strike, infection control measures, official instructions or illness. In such cases, any fees already paid will be refunded. Customers are not entitled to any claims for damages.
Kulturprojekte Berlin GmbH accepts no liability for any damage (personal injury or damage to property) unless the damage incurred is due to intent or gross negligence on the part of the Museumsdienst Berlin of Kulturprojekte Berlin GmbH. The same applies to freelance employees (so-called vicarious agents) of the Museumsdienst. Participation in all city tours and open-air programmes is at your own risk.
Duty of supervision: During the entire visit to the museum and at all other events for the entire duration of the event, the duty of supervision remains with the person(s) in charge. Kulturprojekte Berlin GmbH shall only be liable for damage caused by the cancellation of an event in the event of gross negligence or intent on the part of Kulturprojekte Berlin GmbH's Museumsdienst. Participation in all guided city tours and open-air events is at your own risk. The organiser is not liable for weather-related or other impairments or cancellations of guided tours and open-air offers, unless these were caused by gross negligence on the part of the organiser.
All personal data will be treated confidentially. The Museumsdienst is authorised to collect, store and process all data required in the context of the business relationship within the meaning of the General Data Protection Regulation (GDPR). The customer allows the Museumsdienst to pass on this data to third parties commissioned with the execution of the contract, insofar as this is necessary for the fulfilment of the contract.
The law of the Federal Republic of Germany shall apply. Collateral agreements and amendments to the contract must be made in writing to be valid. This formal requirement cannot be overridden by verbal agreement. The Museumsdienst of Kulturprojekte Berlin GmbH reserves the right to amend these terms and conditions at any time without giving reasons. Such changes shall not apply to bookings that have already been contractually agreed. The place of jurisdiction for disputes is Berlin.
